Hold onto your hats, things are about to get interesting. The Texas Supreme Court has agreed to take up two cases on the issue of the legality of same sex divorce in Texas. Oral arguments have been set for November 5th. A ruling is not expected for months thereafter.
So, what can we expect? Greg Abbott, the Texas Attorney General will surely put up a spirited defense of Texas’ right to draft and implement its own laws governing its citizens. The appellate attorneys for the two gay couples will argue that, in light of the United States Supreme Court’s ruling in Windsor, any law (Texas’ DOMA) that seeks to deny rights to couples because they are gay is unconstitutional.
Where will the merry-go-round stop? My money is on the US Supreme Court. This issue is so polarizing to the parties involved, that it is hard to imagine the loser not seeking federal court intervention.
